Introduction and Acceptance of Terms
Welcome to Clicks & Beyond. These Terms & Conditions explain how we work with clients and how our website, proposals, projects, retainers, and digital services should be understood.
By using our website, requesting a quotation, approving a proposal, making a payment, sharing project materials, or continuing to work with us, you agree to these terms unless a separate written agreement says otherwise.
Description of Services
Clicks & Beyond is a digital growth agency based in Hojai, Assam, India. We help businesses grow through web development, app development, SEO, Google Ads, Facebook and Instagram Ads, AI automation, social media marketing, analytics setup, reporting, consultation, and ongoing optimization.
Our work may include website packages, marketing retainers, custom automation projects, landing pages, campaign setup, tracking setup, content support, post-launch support, and other services agreed with the client in writing.
Client Responsibilities
Clients are responsible for providing accurate business information, website content, images, logos, brand materials, product or service details, access credentials, approvals, and timely feedback needed to complete the work.
If required content, access, approvals, or decisions are delayed, project timelines and campaign launch dates may also be delayed. The client is also responsible for checking the accuracy of business claims, prices, contact details, offers, policies, and other information published on their website, ads, or marketing materials.
Project Scope and Deliverables
The final scope, deliverables, timelines, and pricing depend on the agreed proposal, invoice, quotation, package description, email, message, or other written communication between Clicks & Beyond and the client.
Any item not clearly included in the agreed scope will be treated as additional work. We aim to keep communication clear so both sides understand what is included before work begins.
Pricing and Payment Terms
Most projects require an advance payment before work begins. Depending on the project, payments may be structured as advance payments, milestone payments, monthly retainers, or custom payment schedules agreed in writing.
Retainers and ongoing service fees are payable according to the agreed billing cycle. Late payments may pause work, delay delivery, or limit access to support until pending amounts are cleared.
Prices are shared transparently based on the agreed scope. There are no hidden costs unless the client requests additional work, extra features, third-party tools, paid plugins, hosting, ad spend, content, revisions beyond scope, or other services not included in the original agreement. Taxes, if applicable, may be added as required.
Revisions and Change Requests
Included revisions depend on the agreed package or proposal. Revisions are meant for reasonable improvements to agreed work, such as text changes, layout adjustments, design refinements, or minor content updates.
Major changes, new pages, new features, extra integrations, strategy changes, redesign requests, repeated direction changes, or work beyond the approved scope may require additional charges and revised timelines.
Timelines and Delays
Project timelines are estimates based on the agreed scope and expected client cooperation. Delivery depends on timely content, access, approvals, feedback, third-party platform availability, technical dependencies, and any integrations required.
Clicks & Beyond will make reasonable efforts to meet agreed timelines, but delays caused by pending client inputs, platform issues, hosting problems, domain issues, payment delays, or third-party services are outside our direct control.
Cancellations and Refunds
Because our services involve planning, strategy, design, development, setup, consultation, research, and time-based work, refunds are handled carefully and fairly based on the work already completed.
Payments for completed work, strategy time, consultation, design concepts, development work, campaign setup, automation setup, tracking setup, content work, third-party expenses, paid tools, hosting, domains, plugins, and other committed costs are generally non-refundable.
If a project is cancelled before completion, Clicks & Beyond may calculate any refund, pending payment, or credit based on the stage of work, time spent, costs incurred, and deliverables already prepared. Third-party expenses are not refundable by Clicks & Beyond.
Third-Party Tools and Platforms
Many projects rely on third-party services such as hosting companies, domain providers, plugins, CMS tools, Meta platforms, Google platforms, analytics tools, AI tools, payment gateways, APIs, email providers, CRM systems, automation tools, and other software.
Clicks & Beyond is not responsible for third-party downtime, bugs, account restrictions, policy changes, ad disapprovals, platform decisions, API changes, feature removals, price changes, data loss, or service interruptions caused by those providers.
Advertising and Marketing Performance
We use professional care, best practices, data, testing, and optimization to improve marketing performance. However, digital marketing results depend on many factors, including budget, offer quality, audience, competition, landing pages, seasonality, platform policies, and customer behavior.
Clicks & Beyond does not guarantee specific rankings, leads, sales, revenue, profit, return on ad spend, ad approvals, account approvals, traffic numbers, conversions, or SEO positions.
SEO Terms
SEO is a long-term process. Results depend on search engine algorithms, competition, content quality, website authority, technical website health, backlinks, user experience, business location, and ongoing consistency.
We may recommend technical improvements, content updates, keyword planning, on-page optimization, blog structures, local SEO improvements, and reporting. Search engines make their own ranking decisions, so no specific ranking position or timeline can be guaranteed.
Website, App Maintenance, and Support
Post-launch support may include bug fixes, minor content updates, tracking checks, basic guidance, plugin or CMS checks, backups, speed improvements, uptime review, and small technical adjustments depending on the agreed plan.
Maintenance does not include major redesigns, new pages, new features, advanced development, new automations, paid tool costs, third-party recovery, malware cleanup, hosting migration, or emergency support unless these are included in a maintenance plan or separately agreed.
Intellectual Property
After full payment is received, the client owns the final approved deliverables created specifically for the client, such as approved website pages, final design assets, written content, and agreed project outputs, unless otherwise stated in writing.
Clicks & Beyond may retain ownership of internal tools, frameworks, reusable code, development processes, templates, methods, know-how, strategy frameworks, and pre-existing materials used to deliver the work.
Clients must ensure that any content, images, videos, fonts, logos, documents, trademarks, product information, and other materials supplied to Clicks & Beyond are legally owned, licensed, or permitted for use.
Portfolio Usage
Unless the client requests confidentiality in writing, Clicks & Beyond may showcase completed work, brand names, website screenshots, campaign examples, results summaries, testimonials, or project descriptions in our portfolio, case studies, social media, proposals, or marketing materials.
We will avoid sharing sensitive private information, login details, confidential business data, or internal documents without permission.
Confidentiality
We respect client confidentiality. Business information, login credentials, campaign data, analytics information, automation workflows, private project discussions, and sensitive materials shared with us will be handled responsibly.
Clients should avoid sharing unnecessary passwords and should update or revoke access when a project or engagement ends.
Data Privacy
Clicks & Beyond may handle client information, leads, analytics data, website access, ad account access, CRM data, and other project-related information only for the purpose of providing agreed services.
We aim to use reasonable care when handling access credentials, client data, and reporting information. We do not claim compliance with every privacy law or industry standard unless separately verified and agreed in writing.
Limitation of Liability
To the maximum extent permitted by applicable law, Clicks & Beyond will not be liable for indirect losses, business interruption, lost revenue, lost profit, loss of data, platform restrictions, third-party failures, ad account issues, hosting issues, search engine changes, or decisions made by third-party providers.
Our total liability for any claim related to a project or service will be limited to the amount paid by the client for the specific service giving rise to the claim, unless applicable law requires otherwise.
Warranties and Disclaimers
Clicks & Beyond provides services with professional care and practical effort. However, outcomes depend on client cooperation, content quality, market conditions, competition, customer behavior, platform policies, third-party tools, and technical dependencies.
We do not promise that any website, app, campaign, automation, SEO activity, or marketing strategy will produce guaranteed commercial results.
Termination
Either party may request to terminate an ongoing project or retainer by giving written notice. On termination, the client must pay for all completed work, approved milestones, time spent, third-party costs, committed expenses, and any pending invoices up to the termination date.
Clicks & Beyond may pause or terminate services if payments are overdue, required access is not provided, communication stops, requested work is unlawful or unethical, or the client misuses third-party platforms. After termination, access may be handed over or removed depending on payment status and project requirements.
Governing Law and Jurisdiction
These terms are governed by the laws of India. Subject to applicable law, disputes will fall under the jurisdiction of the appropriate courts in Assam, India, unless a separate written agreement states otherwise.
Updates to These Terms
Clicks & Beyond may update these Terms & Conditions from time to time to reflect changes in our services, tools, processes, pricing structure, or legal requirements. The updated version will be published on this website with the latest effective date where applicable.
